Users that do not fully agree should not use our website or services. These terms may be updated at any point in time. It is the website viewers’ responsibility to check for any changes or request them from the front desk. Sarasota Wellness MD (henceforth known as SWMD) is proud to be a woman & physician-owned and operated private medical practice. We are excited to help patients achieve & maintain their overall wellness through holistic and healthy methods; avoiding unwanted “band-aid” medications, we utilize specialty testing methods to help figure out the root-cause of pain/illness/disease to get you feeling your best!

SWMD abides by and upholds the laws outlined by the Health Insurance Portability and Accountability Act (HIPAA) of 1996.

Consent Related to Privacy Policy:

SWMD respects your right to privacy. By using this website and agreeing to these terms you, the user, also consent to SWMD’s Privacy Policy. You understand that the terms of the Privacy Policy may change and you may obtain these revised notices by checking our website or contacting the front desk. You understand you have the right to request how your protected health information (PHI) has been disclosed. You also have the right to restrict how this information is disclosed, but SWMD is not required to agree to your restrictions. If it does agree to your restrictions on PHI use, SWMD is bound by that agreement, may it be verbal or written.

Terms & Consent for Care:

Patients authorize SWMD, and any employee working under the direction of their providers, to provide medical care for themselves, or to a patient for which they are the legal guardian of. This medical care may include services and supplies related to their health (or the identified person) and may include, but is not limited to, preventative, diagnostic, therapeutic, rehabilitative, maintenance, or counseling.

Terms & Consent for Release of Information and Assignment of Benefits:

Upon joining our practice, patients authorize Sarasota Wellness MD to provide information to the identified insurance carrier(s) for any and all appointment activities, payment activities, authorizations, disputes, etc.

SWMD may provide any necessary medical information to lawyers, government officials, organ & tissue procurement organizations, medical examiners or coroners when needed or in the event of a legal investigation or death.

SWMD may discuss your health information within our staff operation for quality and training purposes, with goals to always be improving our staff and level of care.

Conduct & Anti-Discrimination Policy:

Sarasota Wellness MD complies with Federal Civil Rights Laws and does not discriminate or exclude based on race, national origin, color, gender/identification or sexual orientation, age, or disability.

SWMD’s providers & staff strive to provide you with top-tier medical AND personal care; because to us, you aren’t just a number!

Should any patient, partner, representative, or consumer feel they are being discriminated against, bullied or harassed by one of SWMD’s providers/employees, they have the right to inform the business owner and other appropriate parties and/or authorities.

Should any member of the SWMD staff feel they are being discriminated against, bullied or harassed by a patient, partner, representative, or consumer, SWMD has the right to dismiss/fire the person in question immediately and contact appropriate parties and/or authorities.

Phone call, mobile/texting agreement:

All phone calls are recorded for quality assurance & training purposes. Your phone number(s) will never be shared with third parties for marketing purposes. All texts are in compliance with the Health Insurance Portability & Accountability Act (HIPAA) of 1996. By providing your phone number to Sarasota Wellness MD and its constituents, you consent to receive SMS text messages from Sarasota Wellness MD for general two-way communication, appointment reminders, marketing and closure messages. Message frequency varies. Message and data rates may apply. Reply HELP for support. Reply STOP to opt-out.

Third-Party Website Links

Although our website provides direct access links to third-party websites as a convenience to our active or prospective patients, that does not imply our endorsement of the linked site by SWMD. SWMD is not responsible for the content, practices, privacy policies or terms belonging to any internet links provided on our website.

Financial Policy:

We appreciate you choosing us for your healthcare. We will adhere to the following financial policy in order to consistently deliver high quality care and services. The patient/responsible party assumes responsibility to ensure that the financial obligation is fulfilled for the health care services received.

  • Patients/responsible parties understand that SWMD is a cash-pay facility and does not accept insurance nor submit on a patients’ behalf for any visits they may have with any of SWMD’s providers.
  • Patients/responsible parties understand that SWMD may submit the patients’ labs to insurance upon request, but that they, the patient, will be fully responsible for any bills or disputes received by their insurance company thereafter.
  • Patients/responsible parties understand that they are solely responsible for all payments and other amounts that may be deemed their responsibility by the payment sources, as required by their contract with SWMD, their insurance plan and state regulations.
  • Patients/responsible parties understand that if they submit for reimbursement for any procedures, specialty lab kits, injections, IV Therapy, or supplements, the patients contract with their insurance entity may or may not cover some services.
  • Patients/responsible parties understand that they are expected to make full payment at the time of service when checking out from their appointment under SWMD’s Fee for Service Contract.
  • Patients under SWMD’s Concierge Contract commit to annual, quarterly, or monthly payment plans and are responsible for all totals within those contracts and are expected to be made in a timely manner. Failure to provide dues after 3 months of no attempts to contact SWMD will result in the patient’s immediate dismissal from our practice and relinquishment of any rights to care from any of our providers now or in the future.
  • BE ADVISED: All insurance policies are not the same. They vary by employer group. Providers & staff at SWMD are not responsible or able to know every policy available. It is your responsibility as the policy owner to verify applicable coverage prior to receiving the services. If you seek care outside of the contract terms, you are aware that you may be responsible for all charges that are incurred.

Refund & Return Policy:

At SWMD, we strive to provide you with what we believe to be top-shelf products. We are always happy to provide refunds/returns when we are responsible for damages or if the item in question has not been opened or used. It is SWMD’s right to refuse returns of any damaged products, whether shipped to a patient/consumer’s home by a third-party or if purchased on-site.

If a product purchased on-site had no noticeable damage when leaving the premises, is opened, or upon the suspicion of damage caused by the patient/consumer, it is SWMD’s right to refuse the return.

If a product purchased from SWMD gets shipped by a courier from a third-party facility and arrives damaged, it is the third party or courier’s responsibility/decision to claim any damages, should they be responsible. SWMD IS ONLY RESPONSIBLE FOR COLLECTING THE PAYMENT UPON ORDERING PRODUCTS BEING SHIPPED TO A PATIENTS’ HOME. Responsible parties for the refunds of these items, should they arrive damaged, will be decided based on where & when the damage took place (i.e. production or delivery). If the courier or pharmacy does not deem it their responsibility to cover a refund, that does not make SWMD responsible.

Please see the next section for replacement and/or refund policies when it comes to travelling with injectable medication.

Injectable Medications & Travel Policy:

It is the patients’ sole responsibility to check with their airline when traveling with an injectable medication. If you, the patient/traveller, fails to contact your airline and/or provide the proper documentation or follow specified guidelines provided by your airline, and your medication and/or supplies are surrendered/discarded by the Transportation Security Administration (TSA), SWMD nor its partners are responsible in any way; there will be no refunds or replacements.

Product Wholesaler/Consumer Agreement:

SWMD abides by any and all laws/regulations with our selling partners & affiliates. Patients and users consent & understand that not all products have been evaluated by the United States Food & Drug Administration (FDA). SWMD does not use or advertise any supplements, IV Therapy or injections to be used with intent to diagnose, treat, cure, or prevent disease. If a consumer does not agree with these terms, they should not use our products.

Supplement Counseling & Sales:

Patients, website users, and non-patient consumers consent and understand that not all supplements (sold within or outside of SWMD’s physical location or website) have been evaluated by the United States Food & Drug Administration (FDA). These products are not intended to diagnose, treat, cure, or prevent disease. If the patient, legal guardian of a patient, and/or consumer does not agree with these terms, they should not use those products.

It is understood that any supplement counseling provided are suggestions, not requirements by your healthcare provider. Please read all labels carefully and do not use any products outside the guidelines of your healthcare provider.

Compounded Medication Counseling & Sales:

SWMD partners with local and national compounding pharmacies to provide top-quality compounded medications at a fair price. While SWMD may collect payment for compounded medications provided by our partners, SWMD does not make or keep any ingredients for the creation of any compounded medications on site. Those partners are solely responsible for their products, policies and terms of use and services.

Patients consent and understand that compounded medications (sold within or outside of SWMD and its partners) have not been evaluated by the United States Food & Drug Administration (FDA). These products are not intended to diagnose, treat, cure, or prevent disease. If the patient, legal guardian of a patient, and/or consumer does not agree with these terms, they should not use these products.

It is understood that any medication counseling provided by your healthcare provider are suggestions, not requirements. Please read all labels carefully and do not use any products outside the guidelines of your healthcare provider.

Reservation of Rights:

SWMD reserves the right to, in discretion, request that you remove any information or links to our website, phone number, or physical address from any social media platform or website you may own and/or edit. We also reserve the right to request the immediate removal of reviews and/or comments on reviews that are linked to SWMD in any way that may be deemed inappropriate, offensive, degrading, illegal, threatening, abusive or harassing/bullying. By accessing our website link or by providing access to

our website link, you agree to remove all links, reviews, and/ or comments to our website immediately upon request and understand that we may change these rights at any time.
